At least two residents are poised to sue for damages. The local law firm of Liakos & Matukewicz is representing these two (and possibly several others) on a lawsuit.
While the HOA is not privy to all the intricacies of the pending suit, the intended named parties, or the Acts and Statutes which will be cited in the legal process moving forward, residents should know the HOA has had contact with Mike Matukewicz about the termite infestation; it is the HOA's lay opinion that Matukewicz is well versed on the various issues and it would seem there exists a reasonable likelihood that the suite will prevail.
The HOA is not in the financial position to enjoin itself with the lawsuit or help defray attorneys fees if/until such time the case becomes Class Action in nature. That said, Mr. Matukewicz will make every effort to work with individual resident/clients who would like to contact his firm about legal action for termite infestation and/or the lack of proper treatment to those homes not yet facing infestation. It may only be a matter of time, so the HOA encourages all residents to call Matukewicz and the State of Nebraska (see previous post).
